GENERAL TERMS AND CONDITIONS OF SALE
1.1 Parise Compressori S.r.l. is based in Olmo di Creazzo (VI) Via F. Filzi, 57 – 36051 - ITALY
1.2 The website www.parisecompressori.com is operated by Parise Compressori S.r.l.
1.3 These General Conditions of Sale (hereinafter referred to as "General Conditions”) govern the sale of products marketed by www.parisecompressori.com. All agreements to purchase products between the seller and the customer through the www.parisecompressori.com website and in accordance with the procedures described herein, are governed by these General Conditions.
2. Acceptance of the general conditions of sale
2.1 The agreement between Parise Compressori S.r.l. and the customer shall be considered to be concluded upon the acceptance, even partial, of the order by Parise Compressori S.r.l., who reserves the right to accept the order at its sole discretion. Acceptance shall be implicit unless the customer is notified otherwise, by any means. By placing an order, by any of the methods available, the Customer declares that he has read all the information provided during the purchasing process and that he / she fully accepts the General Conditions and the conditions of payment indicated below.
2.2 If the customer is a consumer (i.e. a person who buys goods for purposes not related to his / her business), once the online purchasing procedure is complete, he / she will print or save an electronic copy of or anyway keep a copy of these General Conditions of sale in accordance with the provisions of article 7 of Legislative Decree No. 206/2005 regarding distance selling.
2.3 The customer is not entitled to claim any damages or compensation, or to claim contractual or tort liability for direct or indirect damages to persons and / or property caused by the non-acceptance, even partial, of an order.
3.1 The customer can only purchase the products listed in the electronic catalogue of www.parisecompressori.com at the time the order is placed and which can be viewed at (URL) http:// www.parisecompressori.com, as described in the relative information sheets. It is understood that the picture that accompanies product description sheet may not be fully representative of its characteristics and that it may differ in terms of the colour, size and the accessories indicated in the picture. All the information provided to assist the purchasing process should be interpreted as general information that cannot be applied to the specific characteristics of each individual product.
3.2 Parise Compressori S.r.l. will confirm receipt of the order via an automatic e-mail, sent to the e-mail address indicated by the customer during the order process. This confirmation message will indicate the Date and Time that the order was placed and an ‘Order Number’ that should be used in all future communications with Parise Compressori S.r.l. The message will show all the information that was entered by the Customer, who must then make sure that it is correct and promptly communicate any corrections that may be required, according to the procedures described in this document. The customer can check the status of the order by accessing the area of the website area dedicated to him / her. In order to access this area, the customer must login to the website (‘Sign in’ at the top right hand corner) and then select “Order history and details".
3.3 Parise Compressori S.r.l. will promptly notify the customer if the order is not accepted, using the same method.
3.4 On certain products, which are subject to price promotions, Parise Compressori S.r.l. reserves the right to accept orders by reducing the quantities requested, upon giving notice to and on acceptance by the customer, failing which the order will be cancelled.
3.5 All prices shown on the website are intended as prices to the public and therefore include Italian VAT. Parise Compressori S.r.l. reserves the right to modify prices at any time and without notice. Customers will not be entitled to any form of compensation in the event of changes in price.
3.6 For VAT customers, an invoice will be issued indicating the VAT rate applied.
3.7 For private individuals, VAT will be paid via a fiscal representative in Italy.
4. Methods of payment
4.1 Bank transfer If paying in advance by bank transfer, the order made by the customer will be held for 5 working days. If within five days the customer has not forwarded a copy of bank transfer, the order will automatically be cancelled. The bank transfer reference must include the order number that was received in the order confirmation e-mail and the SURNAME of the sender.

4.3 If you are using a Credit Card to purchase goods, the card will be debited at the end of the online process.
4.4 If the order is cancelled, either by the Customer or if is not accepted by Parise Compressori S.r.l., Parise Compressori S.r.l will make a request for the transaction to be cancelled and at the same time release the amounts involved. The order can be cancelled up until the time of delivery of the goods to the courier. The redemption period for certain types of cards depends exclusively on the banking system and can take up until to their natural expiration (24 days from the date of authorization). Once the request to cancel the transaction has been made, under no circumstances can Parise Compressori S.r.l. be held liable for any damages, direct or indirect, caused by a delay in releasing the amounts by the banking system.
4.5 Parise Compressori S.r.l. reserves the right to ask the Customer to provide additional information (e.g. landline phone number) or to be sent copies of documents proving the ownership of the Credit card that was used. Parise Compressori S.r.l. reserves the right not to accept the order if the documentation requested is not received.

Under no circumstances can Parise Compressori S.r.l. therefore be held responsible for any fraudulent and improper use of credit cards by third parties when paying for products purchased on www.parisecompressori.com.
4.7 PayPal: if purchasing goods via PayPal, as soon as the online transaction has been completed, PayPal will immediately debit the amount of your purchase.
5. Collection methods
5.1 Parise Compressori S.r.l. can only accept orders to be collected by or on behalf of the customer. Goods may only be collected by courier.
5.2 For every order made on www.parisecompressori.com, Parise Compressori S.r.l. will issue a transport document (DDT) for the materials sold. The information provided by the customer at the time of placing the order will be used for issuing the transportation document. The costs for delivery of the goods are charged to the customer and are indicated at the time of placing the order. Payment for the goods by the customer will be made according to the method chosen at the time of placing the order. No additional fee or commission is due to Parise Compressori S.r.l. Delivery times for the ordered goods are indicative only, and are shown in the “Delivery and Returns” section. These may be subject to changes due to ‘force majeure’, traffic or road conditions in general or by act of the authority. Delivery, unless otherwise agreed in writing between the parties, will be from 8.30 to 12.30 and from 14.30 to 18.30, Mondays to Fridays, except on holidays. Under no circumstances can Parise Compressori S.r.l. be held responsible for delays in processing the order.
5.3 When the goods are received, the Customer must check:
- That the number of packages is the same as the number indicated on the transport document;
- That the packaging is intact, undamaged, not wet or in any way spoilt, including any materials used to close it (adhesive tape or metal strapping). Any damage to the packaging and / or the product, or a discrepancy in the number of packages or information, must be pointed out immediately, and SUBJECT TO VERIFICATION written on the courier’s proof of delivery. Once the courier’s document has been, signed the Customer may no longer make any complaint regarding the external appearance of the goods delivered. Even if the packaging is intact, we recommend that you write “subject to verification” on the document in order to be covered for any hidden damage. The goods must be checked within 48 hours of receipt. Any defects must be reported in writing by recorded delivery with a return receipt. Any problems reported after the times indicated above will not be taken into consideration. If “subject to verification” was not written on the delivery documentation, it will not be possible to start the refund procedure. Once the customer has signed the courier’s document, without having written ‘subject to verification’, he / she may no longer make any complaint regarding the external appearance of the goods delivered. Any issues there may be regarding the integrity or completeness of the products, or discrepancies in the number of packages received, must be notified within 6 days of delivery, according to the procedures described in this document.
6. Right to withdraw
6.1 If the customer is a consumer (i.e. a person who buys goods for purposes not related to his / her business, or a person who does not indicate a VAT number on the order form when making a purchase), he / she is entitled to cancel the order for any reason, without providing an explanation and without penalty.
6.2 In order to exercise this right, the customer must follow the procedure required by current legislation. The consumer is entitled to exercise his right of withdrawal within 14days of receiving the goods.
6.3 The right of withdrawal is anyway subject to the following conditions:
- The right of withdrawal applies to the goods purchased as a whole. It is therefore not possible to exercise the right of withdrawal on only a part of the product purchased (e.g. accessories, pipes, fittings, etc.).
- The right of withdrawal does not apply to products made to specification or that have been clearly customised.
- The purchased product must be integral and returned in its original packaging, complete with all its parts (including packaging materials and any documentation, accessories, manuals, cables etc.). In order to minimise damage to the original packaging we recommend placing it in another box, where possible. Avoid attaching labels or adhesive tape directly onto the original packaging.
- Return shipping costs for the goods are borne by the customer. The transport costs for returned goods varies according to weight and volume (a ratio of 1:250). The rate is approximately € 1 per kg for Italy, while for areas that are considered remote or difficult to reach (Calabria, Sicily, Sardinia, islands, mountain resorts or similar), the rate is € 2 per kg.
- The goods are entirely the responsibility of the customer until they have been delivered to our warehouse and a receipt issued.
- Under no circumstances will Parise Compressori S.r.l. be held responsible for damage, theft or loss of goods that are returned in uninsured shipments.
- On arrival at our warehouse, the product will be inspected in order to assess any damage that may not be attributable to transport. If the original package and / or packaging materials are found to be damaged, Parise Compressori S.r.l. will withhold a percentage, which anyway will not be more than10%, as a contribution to repair costs.
6.4 The customer will forfeit his / her right to withdrawal if the product is not returned integral (the package and / or its contents), in the event that Parise Compressori S.r.l. ascertains:
- The absence of the original external and / or internal packaging materials.
- The absence of product components (accessories, manuals, parts etc.) or faults with the product itself.
- Any damage to the product for reasons not attributable to transport. If for any reason the customer forfeits his right to withdrawal, the goods will be held at the premises of Parise Compressori S.r.l. and made available to the customer so that he/ she can collect them at his own cost.
7.1 All products sold by Parise Compressori S.r.l. are covered by the standard manufacturer's warranty and a 24-month warranty against conformity defects. In order to receive assistance under warranty, the Customer must keep the document that he will receive together with the purchased goods.
7.2 The manufacturer’s standard warranty is provided as indicated in the documentation found inside the product packaging. If an Authorized Service Centre or Parise Compressori is asked to investigate a fault and finds that it is not covered by the warranty, the customer will be charged for any inspection or repair costs requested by the Authorized Service Centre, as well as transportation costs, if incurred by Parise Compressori S.r.l.
7.3 The 24 month warranty, pursuant to Legislative Decree No. 24/02, applies to a product having a conformity defect provided it is used properly, in compliance with its intended use and as provided for in the technical documentation. This guarantee, in accordance with Legislative Decree No. 24/92, is limited exclusively to private consumers (a person who buys goods for purposes not related to his / her business or does not indicate a VAT number on the order form when making a purchase). In the case of a conformity defect, Parise Compressori S.r.l. will make the product compliant by repair / replacement or offer a reduction in price, until the termination of the agreement as provided for by legislation.
7.4 Replacements in the event that the product does not work when it is first switched on (Dead On Arrival: DOA), without prejudice to the conditions for the application of Legislative Decree 24/02, will be made only if specifically provided for by the manufacturer. The length of time required for the replacement or repair of the product is exclusively that indicated by the manufacturer. The customer may therefore contact the service centres directly or commission Parise Compressori S.r.l. to deal with the fault. Transport costs will in any case be borne by the customer.
7.5 In the event that, and for whatever reason, Parise Compressori S.r.l. is unable to replace a product under warranty (repaired or substituted) it may, with the prior agreement of the customer, replace it with the same product (if still in the price list) or with another one of equal value and characteristics, or issue a discount voucher of the same amount be spent on another product and valid for six months from the date of issue.
7.6 Under no circumstances can Parise Compressori S.r.l. be held liable for damages for delays in repairing or replacing products under warranty.
7.7 In cases in which the application of the warranty involves the return of the product, it shall be returned by the Customer in its original packaging, complete with all its parts (including packaging materials, any documentation and accessories: manuals, cables etc.). In order to minimise damage to the original packaging we recommend placing it in another box, where possible. Avoid attaching labels or adhesive tape directly onto the original packaging.
8. Faulty products
8.1 Send an e-mail to firstname.lastname@example.org describing the problem you are experiencing or indicate that you wish to exercise your right of withdrawal.
8.2 In your e-mail, indicate all the information received in the order confirmation e-mail and a phone number at which you can be contacted.
8.3 You will be contacted by Parise Compressori to ascertain what the problem is or, if the product has been used incorrectly, to offer the necessary assistance for you to get the best performance from the compressor.
8.4 If it has been ascertained that there is a fault, Parise Compressori will arrange for the product to be collected by a courier.
8.5 After the arrangements have been made, a courier will collect the product and forward it to Parise Compressori.
8.5 You will be contacted again for feedback regarding the fault or the non-conformity of the product. 6. An estimate for repair costs will be made for faulty compressors that are not covered by warranty.
9. Product return procedure
9.1 Send a Product Return Request e-mail within 14 working days of receiving the goods to email@example.com indicating:
_Name and Surname of the user
_Contact phone number
_Address from which to collect the product
_The order information indicated in the order confirmation e-mail (order number, product code or model etc.)
9.2 Parise Compressori will contact you shortly to make arrangements for and agree on the time for collecting the product.
9.3 After arrangements have been made with the customer, a courier will collect the product from the customer and forward it to Parise Compressori.
9.4 Within 14 working days of receiving the product, and once the integrity of the product delivered has been confirmed in accordance with section 6.4, Parise Compressori will issue a refund according to the procedures specified by current legislation.
9.5 This procedure also applies to requests for the replacement of a product with a different model.
10.1 The personal information requested when the order is made is collected by Parise Compressori S.r.l. and processed on computer media, in order to meet contractual obligations arising from the agreement made with the Customer and under no circumstances will it be transferred to third parties.
10.2 Parise Compressori S.r.l. guarantees compliance with legislation regarding the processing of personal information.
10.3 The data controller is Parise Compressori S.r.l. Via F. Filzi, 57 36051 Olmo di Creazzo (VI) in the person who is the legal representative, unless a manager is appointed. The Customer has the right to withdraw consent to the processing of personal information at any time by sending written notice to the registered office of Parise Compressori S.r.l.
10.4 Marketing communications will be sent only with the express consent of the Customer given together with the authorization for the processing of personal information and the submission of the online registration form.
11.1 Any complaints must be sent to Parise Compressori S.r.l. using the "Contact us" form or by e-mail to firstname.lastname@example.org, after which the customer will be contacted as soon as possible in order to resolve the issue.
12. Applicable law and Jurisdiction
12.1 The sales agreement between the Customer and Parise Compressori S.r.l. is regarded as having been made in Vicenza. The Court of Vicenza will have exclusive jurisdiction over civil and criminal litigation arising from this distance sales contract.
13. Changes to the Conditions
13.1 The conditions indicated in this document may be modified by Parise Compressori S.r.l. without notice and will be valid from the date of publication on the website www.parisecompressori.com.
